JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-03-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the victim is languishing in jail since 25.03.2014 in a case registered for the offences punishable under Sections 304B, 498A and 201/34 of the Indian Penal Code.

The accusation is of killing the sister of the informant after one year of the marriage for non-fulfillment of the dowry demand. It is alleged that the sister of the informant was pregnant when on 24.03.2014, the petitioner went in-laws house where the informant was residing and on the pretext of illness of his mother took the sister of the informant and thereafter the victim went traceless, subsequently on the confession of the petitioner dead body of the sister of the informant has been recovered.

Patna High Court Cr.Misc. No.11107 of 2016 (2) dt.08-03-2016 2/2 It is submitted by learned counsel for the petitioner that only on suspicion, the accusation has been levelled. Out of eleven chargesheeted witnesses, eight have been examined and the petitioner is in custody since last two years. Considering the nature of accusation and the stage of trial, this Court is not inclined grant bail to the petitioner. Accordingly, the prayer for bail is rejected in connection with Khagaria S.C. No. 291 of 2014 arising out of Khagaria P.S. Case No. 177 of 2014 pending in the court of learned 3rd Adhoc Addl. Sessions Judge, Khagaria.

It is expected from the learned court below to conclude the trial preferably within a period of six months. (Dinesh Kumar Singh, J) Amrendra/- U T
