The petitioners seek bail in a case under Section 364, 302 and other sections of the Indian Penal Code. The police after investigation submitted final form finding accusation false against the petitioners. The petitioners were granted anticipatory bail vide order dated 17.09.2014. The petitioners were enlarged on anticipatory bail subject to verification of their criminal antecedents. On 18.09.2014 Kotwa P.S. case No. 221 of 2014 was registered under section 302 and 34 of the IPC but the police after investigation submitted final form in the case. Since a fresh case was registered against the petitioners,
Patna High Court Cr.Misc. No.20064 of 2015 (3) dt.03-07-2015 2/2 the anticipatory bail granted to the petitioners was cancelled. Considering the facts aforesaid and the nature of allegation made against the petitioners, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions judge, East Champaran, Motihari in Sessions Trial No. 764 of 2014 arising out of Kotwa P.S.
