JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.

It is a case of misuse of privilege of bail. Petitioner was earlier granted privilege of bail but he jumped bail resulting cancellation of his bail bond on 20.11.2012 but subsequently, on 11.01.2016 petitioner voluntarily surrendered before the trial court and since then he is languishing in jail custody. No doubt, on 20.11.2012, attendance of a prosecution witness had been filed but due to absence of the petitioner, the deposition of aforesaid witness could not be recorded but petitioner has sufficiently been

Patna High Court Cr.Misc. No.13831 of 2016 (2) dt.18-05-2016 2/2 punished by remaining in jail custody for near about four months for the above stated fault.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Muzaffarpur in connection with Sessions Trial No. 421 of 2013 arising out of Pear P.S. Case No. 15 of 2007.
