The petitioner seeks bail in connection with Raniganj P.S. Case No. 494 of 2020 registered for the offence punishable under Section 379 of the I.PC.

The learned counsel for the petitioner submits that the petitioner is in custody since 24.12.2020, charge-sheet has been submitted in the case and has antecedent of two cases and the allegation is of committing theft of Rs. 50,000/- after breaking the dicky of the motorcycle of the informant by unknown thieves.

The learned counsel submits that the FIR was against unknown, petitioner was arrested in a different case where he was made to confess his participation in the present occurrence,

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and his name transpired in his own confessional statement as aforesaid, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Raniganj P.S. Case No. 494 of 2020 with a condition that one of the bailor of the petitioner shall be his mother Bholi Devi.
