JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.

Petitioner is named in the first information report on the accusation that he along with others including one Pawan Yadav @ Pawaniya committed dacoity in the wine shop of the informant and subsequently, co-accused Pawan Yadav @ Pawaniya was arrested and one country made loaded pistol and looted amount as well as some receipts were recovered from his conscious possession.

Learned counsel for the petitioner submits that neither petitioner was caught on spot nor anything was recovered from his

No.11877 of 2016 (2) dt.17-03-2016 2/2 conscious possession and the first information report reflects that a dispute took place between the parties on the point of demand of donation. Petitioner does not have any criminal antecedent and the investigation upon him appears to have been completed. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur in connection with Nathnagar (Lalmatia) P.S. Case No.172 of 2015.
