The petitioner seeks his bail in Raniganj P.S.Case No.202 of 2014 registered under Sections 376, 201, 343, 202 and 34 IPC. The informant made allegation that the petitioner forcibly took away and committed rape with her. The petitioner was apprehended, a Panchayati was held and it was decided that the petitioner should be married to the victim but later on, the petitioner did not obey the decision of the Panches.
It is submitted that the occurrence is of 11.8.2014 but the FIR was lodged on 27.8.2014. The doctor did not find any injury on the victim and her age was assessed as 17-19 years. The victim appears to be major and a consenting party.
Considering the facts aforesaid and the fact that the case was lodged after 12 days of the occurrence, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Singh, Judicial Magistrate, Ist Class, Araria in connection with Raniganj P.S.Case No. 202 of 2014.
