JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Section 304 (B) of the Indian Penal Code.
Petitioners happen to be elders brother-in-law of the deceased and are languishing in jail custody since 21.11.2015 and 23.11.2015 respectively.
It is pointed out on behalf of the petitioners that husband as well as father-in-law of the deceased have already been acquitted by the trial court after full-fledged trial and, therefore, the detention of petitioners in jail custody is meaningless. Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.11667 of 2016 (2) dt.15-03-2016 2/2 well as submissions of the parties, let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-III, Lakhisarai, District Lakhisarai in connection with Halsi P.S. Case No.102 of 2010.
