JUSTICE AMARESH KUMAR LAL ORAL ORDER 22-04-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code. The allegation against the petitioner is that on checking by the police, a stolen motorcycle was recovered from the possession of the petitioner which was confessed by the petitioner that he along with the co-accused Hemant Chaudhary had stolen motorcycle and one stolen motorcycle was lying in the house of co-accused Hemant Chaudhary which was been recovered from the house of co-accused Hemant Chaudhary. The petitioner was apprehended with the stolen motorcycle.
It is submitted that it appears from the seizure list that the motorcycle has not been recovered from the possession of the petitioner, rather it has been recovered from Tajpur road. The
Patna High Court Cr.Misc. No.8008 of 2015 (2) dt.22-04-2015 2/2 seizure list also does not bear the signature of the petitioner. However, after investigation, charge sheet has already been submitted. After arrest in this case, the petitioner has been remanded in Patepur P.S. Case No.64/2014.
Considering the facts and circumstances of the case, let the above-named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur/court concerned in Tisiauta P.S. Case No.96/2014 after framing of charge with the following conditions : 1.
One of the bailors will be the close relative of the petitioner.
2.
The petitioner will not indulge in similar or in any other offence.
3.
The petitioner will be well represented in the court.
4.
In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
