====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 17-06-2020 The matter has been taken up through Video Conferencing.

Heard learned counsel for the petitioner no. 2 and learned Additional Public Prosecutor for the State. This application for anticipatory bail is confined to petitioner no. 2 Navin Kumar Singh @ Navin Kumar only. The petitioner no. 2 is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354(B), 447/34 of the Indian Penal Code and Section 12 of the Protection of Children from Sexual Offenses Act, 2012. According to FIR, co-accused Vikash Kumar Singh is alleged to have sexually harassed the informant and for that in a subsequent occurrence the petitioner no. 2 and another allegedly committed assault to the brother of the informant. Submission is that the matter is of love affairs.

No.2262 of 2020(4) dt.17-06-2020 2/2 Considering the nature of allegation and statement of the petitioner no. 2 on oath that he has got no criminal antecedent, let the petitioner no. 2, Navin Kumar Singh @ Navin Kumar, in the event of his arrest or surrender before the learned Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Desri Police Station Case No. 302 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as subject to the following conditions:- (a) The petitioner no. 2 shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner no. 2.

(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.

(c) The petitioner no. 2 shall not leave the country without permission of the learned trial court. (Birendra Kumar, J) Kundan/- U T
