2. The petitioner seeks bail in connection with Simraha P.S. Case No. 158 of 2024 dated 06.11.2024, instituted for the offence punishable under Sections 80, 3(5) of the Bhartiyay Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that there was love affairs between the petitioner and the daughter of the informant. As a result, the marriage of the petitioner was solemnized with his daughter. After marriage, the petitioner and his family members demanded seven lakh rupees as additional dowry. On nonfulfilment of the same, they tortured her physically and mentally. Thereafter on the alleged date of occurrence, he got information on phone call that his daughter died.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. Learned counsel for the petitioner submits that the petitioner is the husband of the deceased. It is further submitted that on the date of occurrence, the deceased herself committed suicide by hanging with the fan. The inquest report reveals that her scarf was seen on fan and post-mortem report also opined that death caused due to hanging. The petitioner neither demanded any dowry nor he tortured the deceased, but his wife committed suicide due to his poverty. Lastly, it has been submitted that the petitioner is in custody since 10.11.2024 having no criminal antecedents. Chargesheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Perused the case diary. Case diary also supports the allegation levelled against the petitioner.

7. Since the petitioner is the husband of the deceased, I am not inclined to grant bail to the petitioner.

8. Accordingly, the prayer for bail on behalf of the petitioner stands rejected.

9. The learned trial court is directed to take all endeavour to conclude the trial within one year from the date of receipt/production of a copy of this order. If the trial is not
