JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-03-2019 This is an application for grant of anticipatory bail in connection with Baniyapur P.S. Case No. 182 of 2018, disclosing offences under Sections 341, 323, 302, 379, 504, 506, 34 of the Indian Penal Code.
Allegation against the petitioner is that he thrashed the deceased on the ground and also assaulted by lathi and danda and there also allegation that he snatched golden chain from the informant and the accused persons also assaulted him. Submission of learned counsel for the petitioner is that the falsity of the case will appear from the fact that postmortem report does not show any internal injury on the person of the deceased and further allegation of assault to the informant is general in nature. The petitioner has no criminal antecedent.
Patna High Court CR. MISC. No.3328 of 2019(3) dt.08-03-2019 2/2 Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the petitioner.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI Chapra, in connection with Baniyapur P.S. Case No. 182 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
