Petitioner is not named in the first information report but in course of investigation, some witnesses claimed to have seen the petitioner wandering near the place of occurrence and, after that, petitioner was arrested in Turkauliya P.S.Case No. 530 of 2015 and confessed his guilt. It appears that except the aforesaid material as well as criminal antecedent of the petitioner, there is nothing against the petitioner.
