Perused the impugned order dated 28.11.2016 passed by learned Musnif III, Patna in Title Eviction Suit No.69 of 2015 whereby the learned Court below rejected the application filed by the defendant petitioner under Section 10 of the Code of Civil Procedure. From perusal of the impugned order, it appears that the Court below has considered all the questions which is being raised before this Court and then has rejected the application.
