JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code and u/s 25(1-AB) of Arms Act. .
As per the prosecution case, while the informant was returning after attending a funeral and reached at Tinmuhani Umanath, four miscreants, who were present there from before, stopped the informant, abused and assaulted him and snatched his pistol and five live cartridges and fled away. It is further alleged that from the persons present there he came to know about the accused persons, including this petitioner, who were involved in the aforesaid crime.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has been implicated in the case
Patna High Court CR. MISC. No.4754 of 2022(2) dt.04-04-2022 2/2 only on suspicion and the identity of person, who disclosed the name of miscreants, has not been disclosed by the informant in the FIR. No incriminating article has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery. Petitioner is in custody since 22.10.2021 and investigation in this case is complete . Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Barh, Patna in connection with Barh PS case No.175/2021.
