Mr. Aditya Narayan Singh.1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 21-04-2026 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered under Sections 189(2), 126(2), 115(2), 103(2) and 109 of Bharatiya Nyaya Sanhita.

3. As per the prosecution case, 26 accused persons including the petitioners assaulted the informant and his family members with lathi, danda, farsa, sword, due to which they sustained injuries and one Sattar Ansari died while he was being rushed to D.M.C.H.

4. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.4811 of 2026(4) dt.21-04-2026 2/3 petitioners are innocent and have falsely been implicated in the present case. Further submission is that there is no specific overt act alleged against the petitioners. Allegation is general and omnibus in nature. Petitioners are women having no criminal antecedent. Petitioner no. 2 having two children, one is infant of one and a half year and another one is two months old. The charge-sheet has been filed against the petitioner no. 2. Petitioner no. 1 undertakes to cooperate in the investigation and trial, wherein petitioner no. 2 undertakes to cooperate in the trial.

5. Learned A.P.P. appearing on behalf of the State opposed the bail application.

6. Having considered the facts and circumstances of the case, submissions of learned counsel for the parties, nature of allegation and petitioners are women having no criminal antecedent, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-I, Madhubani in connection with Basopatti P.S. Case No. 133 of 2025, subject to the conditions as
