JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-06-2015 Heard learned counsels for the petitioner and learned APP for the State.
The petitioner is languishing in custody since 12.02.2015 in case registered for the offences punishable under sections 395/363/365 of the Indian Penal Code and 136 of the Indian Electric Act.
The accusation is of committing dacoity to the power house.
It is submitted by learned counsel for the petitioner that statement has been made at paragraph 7 of the petition that there is no recovery from the petitioner and further statement has been made at paragraph 8 of the petition that petitioner has not been put on Test Identification Parade. It is further submitted that
Patna High Court Cr.Misc. No.19498 of 2015 (2) dt.25-06-2015 2/2 the persons from whose possession the recovery has been made has been released on bail vide Criminal Miscellaneous No. 19772 of 2014.
Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Chandi (Wena) P.S. Case No.290 of 2013.
