The petitioner apprehends his arrest in a case under Sections 406, 468, 471, 420 and 34 of the Indian Penal Code. The petitioner took loan of Rs. 7,45,000/- from the State Bank of India, Frazer Road Branch, Patna. It is alleged that the petitioner filed forged income tax return. It is submitted that loan was advanced on 31.01.2014. The petitioner is paying installments of loan. The petitioner is ready to pay the entire arrear of installments within one month and undertakes to pay installments regularly.

Learned counsel appearing for the State Bank of India, however, opposed the prayer for anticipatory bail to the petitioner.

No.12769 of 2016 (4) dt.27-06-2016 2/2 Since the petitioner is ready to pay the entire arrear of installments within one month from today and shall continue to pay further monthly installments regularly, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in Kotwali P.S. Case No. 280 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

If the petitioner fails to pay the arrear of installments within one month, the learned court below shall cancel the bail bonds of the petitioner.
