JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 26-04-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Arwal P.S. Case No. 330 of 2021, registered for the offences punishable under Sections 30(a)/33/41 of Bihar Prohibition and Excise Act.

As per allegation, a truck was intercepted by the police. Driver and cleaner of the truck were arrested and 4000 litres of spirit was recovered from that truck. The truck driver and cleaner disclosed the names of the main mastermind of the gang as Sita Ram Yadav @ Baba @ Str, Bhola Rai, Ashok Chaudhary @ Ashok Mahto @ Mahto, Ajay Ray @ Birijodhan Ray, Vijay Singh, Mukesh Rai and Munna Kumar @ Munna Kumar Chaudhary.

No.4209 of 2023(2) dt.26-04-2023 2/2 accused Sita Ram Yadav @ Baba @ Str, Ajay Ray @ Birjodhan Ray and Munna Kumar @ Munna Kumar Chaudhary have been granted bail by a co-ordinate Benches of this Court. The learned co-ordinate Bench has granted bail to other accused persons, considering the same, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-II, Jehanabad in connection with Arwal P.S. Case No. 330 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
