Petitioner apprehends arrest in a case registered for the offence punishable under sections 366, 376/34 of the Indian Penal Code.

As per the prosecution case, petitioner along with other accused persons kidnapped16 years old daughter of the informant for marriage. He committed sexual assault upon her.

1. Learned counsel for the petitioner submits that the girl in her statement under Section 164 Cr.P.C has stated that she is 22 years old and has voluntarily married with the petitioner and out of the wedlock they have a child. The present F.I.R has been lodged after 4 months of the alleged occurrence. The petitioner claims clean antecedent.

No.4964 of 2023(2) dt.07-04-2023 2/2 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Rohtas at Sasaram in Sasaram (Town) P.S. case no.600 of 2019 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
