The petitioner seeks bail in Sahar P.S. Case No. 143 of 2014, registered for the offences punishable under Sections 364 & 34 of the Indian Penal Code and Section 27 of the Arms Act. The brother of the deceased alleged that Manoj Chaudhary and Ashok Rai (the petitioner) called Mithilesh Singh. Mithilesh Singh was seen along with Chhotu Kahar and Manoj Chaudhary.

It is submitted that nobody has seen the petitioner along with Mithilesh Singh.

It is submitted that none of the witness has found the petitioner at the place of occurrence. Chhotu Kahar was apprehended and he confessed his guilt and disclosed that Manoj Chaudhary fired on

Patna High Court Cr.Misc. No.8499 of 2015 (3) dt.22-04-2015 2/2 Mithilesh Singh and killed him. Petitioner is also said to have confessed his guilt.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Sahar P.S. Case no. 143 of 2014.
