JUSTICE SANDEEP KUMAR ORAL ORDER 16-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Balrampur (Telta O.P.) P.S. Case No. 142/2022, registered for the offence punishable under Section 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner has no criminal antecedent. From the perusal of F.I.R., it appears that except suspicion nothing has been imposed against the petitioner. Petitioner is in custody since 14.08.2022. Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against

Patna High Court CR. MISC. No.6225 of 2023(3) dt.16-05-2023 2/2 the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Katihar, in connection with Balrampur (Telta O.P.) P.S. Case No. 142/2022.
