JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 341, 323, 327, 354, 379, 363, 366, 367, 504 and 506/34 of the Indian Penal Code.

The victim was admittedly, major and married lady and it is stated that petitioner took the victim somewhere. Informant and her other family members went in search of the victim on the basis of information given by the father of the petitioner but the informant and her family members were humiliated and assaulted by the family members of the petitioner resulting institution of the present case. The victim was recovered from the house of the petitioner and made statement against the

Patna High Court Cr.Misc. No.11918 of 2016 (2) dt.17-03-2016 2/2 petitioner saying that petitioner took her to his home where she was confined and, later on, recovered by the police. Contention on behalf of the petitioner is that victim had herself eloped with petitioner and in her statement, victim nowhere stated about any ill-treatment meted out to her by the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Mithilesh Kumar, J.M. 1st Class, Purnea in connection with Bhawanipur (Akbarpur) P.S. Case No.280 of 2015.
