The petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 18.07.2021, charge-sheet has been submitted in the case and has antecedent of one case. Allegation is of recovery of seven country-made pistol and a mobile from the petitioner, four semi-auto pistol and a mobile from Rajesh Yadav and a mobile from Karelal Yadav. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and even presuming what has been alleged is true, without admitting

Patna High Court CR. MISC. No.3708 of 2022(2) dt.17-05-2022 2/2 for the purposes of bail, then the thrust of the allegation is under the Arms Act and the petitioner has remained in custody for nearly ten months.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner and submits that allegation against the petitioner is of recovery of seven country-made pistol. Considering the fact that the petitioner is in custody since 18.07.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mansi P.S. Case No. 204 of 2021 with a condition that one of the bailors of the petitioner shall be his mother-in-law, Ramkumari Devi. The petitioner shall be released after framing of charges.
