JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioner was rejected by this Court vide order dated 20.03.2014 passed in Cr. Misc. No. 21435 of 2013 but again this bail petition has been filed on the ground that in course of trial the material prosecution witnesses have been declared hostile and they have not claimed to have seen the alleged occurrence. The learned trial court has reported that out of 18 proposed prosecution witnesses, six prosecution witnesses have already been examined and to procure the attendance of remaining prosecution witnesses, the relevant processes have already been issued.
In view of the facts and circumstances of the case as
Patna High Court Cr.Misc. No.17084 of 2015 (3) dt.22-04-2015 2/2 well as submissions of the parties, this petition stands disposed of with direction to the petitioner to make prayer for bail before the court of learned 2nd Additional Sessions Judge, Lakhisarai in connection with session trial no. 756 of 2013 arising out of Lakhisarai( Kabaiya O.P) Case No. 305 of 2012 and if, he does so the concerned court shall consider the bail petition of the petitioner and shall pass appropriate order on the bail petition of the petitioner within a week from the date of its filing,taking note of statements made by prosecution witnesses in course of trial.
