The petitioner seeks bail in Ghoswari P.S. Case No. 39 of 2019, registered for the offence punishable under Sections 498(A), 302, 201 and 34 of the Indian Penal Code. As per the prosecution case, this petitioner along with other co-accused persons killed the daughter of informant due to non-fulfillment of demand of dowry and disposed of her dead body.

It is submitted on behalf of the petitioner that thrust of accusation is against husband of the deceased who is already in custody. Petitioner is Dewar (brother-in-law) of the deceased and he is living separately and has no concern with the family affairs of the deceased and her husband. There is general and omnibus allegation. Petitioner is in custody since 01.02.2021

Patna High Court CR. MISC. No.3768 of 2022(2) dt.31-03-2022 2/2 having no criminal antecedent. Investigation is complete. Considering the facts and circumstances of the case and the fact that petitioner is brother-in-law of the deceased and there is general and omnibus allegation, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-III, Barh, Patna in connection with Ghoswari P.S. Case No. 39 of 2019 corresponding to Sessions Trial No. 423 of 2021.
