The petitioner seeks bail in connection with Goriyakothi P.S. Case No. 106 of 2021 instituted for the offences under Section 30(a) of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 30.11.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 121.5 litres of liquor kept in cartons. Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name was disclosed by one Ram Dev Prasad.

Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.4255 of 2022(2) dt.07-03-2022 2/2 bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent, charge-sheet has been submitted in the case and his name came in the confessional statement of Ram Dev Prasad, let the petitioner above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IIcum-Special Judge, Excise Act, Siwan in connection with Goriyakothi P.S. Case No. 106 of 2021.
