Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147,148,149,353,332,333,307,504,506,379,420,411of the Indian Penal Code, Sections 4 and 40 of Bihar Mines and Mineral Concession Rule, 1972, Sections 2,3 and 4 of Illegal Mining Storage and Transportation Act, 2003 and Section 15 of Environment Protection Act, 1986.

The authorities of the Mining Department intercepted a tractor loaded with unauthorized sand. About 40 to

Patna High Court CR. MISC. No.3282 of 2020(3) dt.26-06-2020 2/2 to 50 peoples assembled there and started protest against action of the authority. The petitioner is also alleged to be a member of the mob. Petitioner has got no criminal antecedent. There is no direct material against the petitioner. Hence, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Ghosi P.S.Case No.318 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case and also the petitioner shall not leave the country without permission of the learned Trial Court , failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
