The petitioner is languishing in custody since 12.03.2014 in a case registered for the offences punishable under section 302, 323 and 504/34 of the Indian Penal Code in connection with Derni P.S. Case No.49 of 2006, pending before the 5th Additional Sessions Judge, Saran at Chapra. The prosecution case is that on protest being made by father of the informant for abusing him, the petitioner and coaccused Lallan Ram threw him from a bridge, as a result, the victim succumbed to the injuries.
It is submitted by learned counsel for the petitioner that during trial, two eye witnesses, namely, Om
Patna High Court Cr.Misc. No.22388 of 2015 (2) dt.09-07-2015 2/2 Prakash Mahto and Teras Mahto, have not supported the prosecution case.
Considering the nature of accusation, this court is not inclined to grant bail to the petitioner at present. Accordingly, the application for bail on behalf of the petitioner is rejected. Let the learned Court below conclude the trial expeditiously. (Dinesh Kumar Singh, J) Ashwini/- U T
