JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.

Informant, his daughter as well as his wife sustained injury in the alleged occurrence. The daughter and wife of the informant sustained simple injury whereas informant did not produce X-ray report in spite of several direction of the investigating officer and hence, opinion regarding the injury of the informant could not be given. Moreover, petitioner and informant are full brothers and submission on behalf of the petitioner is that

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Kotwali P.S. Case No. 244 of 2015.
