Petitioner seeks bail in a case registered for the offence under Sections 363/365 of the Indian Penal Code, later on, Sections 302, 120B, 201 of the I.P.C. and Section 27 of the Arms Act were added.

As per the F.I.R., co-accused Chiku Yadav kidnapped Laxman Yadav (brother of informant) and thereafter, it is alleged that he alongwith other co-accused persons committed the murder of brother of informant.

Petitioner is not named in the FIR. Name of the petitioner has transpired during course of investigation in the confessional statement of co-accused Chandan Kumar, who has already been granted bail by this Court, vide order dated

Patna High Court CR. MISC. No.4705 of 2022(2) dt.01-04-2022 2/2 29.07.2021 passed in Cr.Misc. No. 11985 of 2021 (Annexure-2). Petitioner is in custody since 27.07.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. - V, Bhagalpur in connection with S.T. No. 565 of 2021, arising out of Kahalgaon (Shivnarayanpur) P.S. Case No. 153 of 2020.
