The petitioner seeks bail in Sultanganj P.S. Case No. 254/2018, instituted for offences under Section(s) 401, 379, 411 and 414 of the Indian Penal Code read with Sections 25(1-b)a, 26 and 35 of Arms Act as well as Sections 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that during vehicle checking police intercepted one motorcycle on which three persons were found sitting. They started running away on seeing the police party. They were apprehended after chase by the police. They disclosed their name as Rohit Kumar, Tarzan Kumar and the petitioner. On search, 4.75 litres of foreign liquor along with one mobile phone, CPU and UPS of computer has

Patna High Court Cr.Misc. No.4546 of 2019(2) dt.08-02-2019 2/2 been recovered from possession of this petitioner. Learned counsel for the petitioner has submitted that petitioner is in custody since 08.09.2018. He has been arrested merely on suspicion.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Sultanganj P.S. Case No. 254/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
