The present application has been filed for modification of the order dated 22-01-2019 passed in Cr. Misc. No. 2836 of 2019 by which the petitioner along with four others was granted anticipatory bail in connection with Aurangabad (Town) P.S. Case No. 95 of 2018 pending in the court of learned Chief Judicial Magistrate, Aurangabad and the petitioner was directed to surrender and furnish bail bond in the court below within a period of six weeks.

It is submitted on behalf of the petitioner that due to communication gap, the petitioner was not informed about the

Patna High Court CR. MISC. No.3742 of 2020(2) dt.22-01-2020 2/2 grant of anticipatory bail and due to that, he could not surrender and furnish bail bond in the court below well within the time. It is further prayed on behalf of the counsel for the petitioner that further time may be extended so that the petitioner could surrender and furnish bail bond in the court below. Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the modification application, the period of surrender of the petitioner No. 1 (in Cr. Misc. No. 2836 of 2019) in the court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions shall remain the same as mentioned in the order dated 22-01-2019 passed in Cr. Misc. No. 2836 of 2019. The order dated 22-01-2019 passed in Cr. Misc. No. 2836 of 2019 is modified with regard to the petitioner No. 1 only to the extent as indicated above.

The modification application is, accordingly, disposed of.
