The petitioner seeks regular bail in connection with Giriyak (Katrisarai) P.S. Case No. 527 of 2021 instituted for the offences under Sections 419, 420, 467, 468, 471 of the Indian Penal Code and read with Section 66(C) of the I.T. Act. Learned counsel for the petitioner submits that the petitioner is in custody since 29.10.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the petitioner was arrested only on the basis of suspicion and recovery of SIM and mobile. It is further submitted that no allegation with regard to the same SIM has been used for any crime.

The allegation is that he hacked the data of any person and it is also relevant to state here that in the F.I.R. it has not been mentioned that whose data has been hacked. There is no material against the said allegation alleges in the investigation.

Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 29.10.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Nalanda at Biharsharif in connection with Giriyak (Katrisarai) P.S. Case No. 527 of 2021.
