JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is not named in the first information report but in course of investigation, it came to light that petitioner had given relevant clue to main assailants and, therefore, the aforesaid fact goes to show that petitioner had not taken active part in committing the alleged crime.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.11413 of 2016 (2) dt.15-03-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Parsa P.S. Case No. 128 of 2014.
