HONOURABLE MR JUSTICE RAJIV ROY ORAL ORDER 21-09-2023 Heard Ms Vijaya Laxmi Srivastava, learned counsel for the petitioner and Mr Madhusudan Rai, learned AC to SC XXIII.

2 The prayer is for the following reliefs:

"(i) For issuance of writ in the nature of mandamus directing and commanding the respondents for making payment of the dues amount of ACP/MACP which is due till date after retirement of father of the petitioner.

(ii) For directing and commanding the respondents to make payment of interest of 12% per annum.

(iii) Also for commanding the

Patna High Court CWJC No.1929 of 2020(3) dt.21-09-2023 2/2 respondents for granting the benefit of first ACP and second ACP and the consequential monetary benefit and issue a necessary order in this regard.

(iv) For issuance of any other relief/reliefs for which the petitioner is legally entitled in the eye of law."

3 Learned counsel for the petitioner, at the outset, submits that the documents which were asked for, have been submitted before the concerned respondents but decision is wanting.

4 In the light of the aforesaid submission put forward by the learned counsel for the petitioner, the Director-in-Chief, Health Department, Bihar, Patna (respondent No 2) is directed to look into the matter and pass necessary order withing a period of three months from the date of receipt/production of a copy of this order.

5 Naturally, the consequential benefit has to flow within a period of next two months.

6 The writ petition stands disposed of with the aforesaid direction.
