JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Taking into consideration that petitioner is said to be main assailant of the deceased, I do not think it proper to release the petitioner on bail and hence, his prayer for bail in connection with session trial no. 18 of 2013/116 of 2014, pending in the court of Additional District Judge 6th, Kaimur at Bhabua is again rejected.

However, the learned Additional District Judge 6th, Kaimur at Bhabua is directed to conclude the trial of the petitioner within six months from the date of receipt/ production of copy of this order even by taking the above stated case on day to day basis. Learned Sessions Judge, Kaimur at Bhabua is also directed to keep

Patna High Court Cr.Misc. No.20987 of 2015 (3) dt.24-06-2015 2/2 strict vigil over the above stated sessions trial and ensure the disposal of the aforesaid case within time as framed by this Court. Let copy of this order be sent to Superintendent of police Kaimur at Bhabua with direction to him to ensure the presence of remaining prosecution witnesses of the above stated session trial no. 118 of 2013/116 of 2014 arising out of Chainpur P.S.Case No. 92 of 2012 before the court of Additional Ditrict Judge 6th, Kaimur at Bhabua within three months from the date of receipt/ production of copy of this order. In case of failure on the part of the trial court to conclude the trial of the petitioner within the above stated period of six months, the petitioner shall be at liberty to renew his prayer for bail before the trial court itself.
