JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 29-04-2015 The petitioner seeks bail in connection with Nawadah Town P.S. Case No.227 of 2014 registered for the offences punishable under sections 379 and 411 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected by this court vide order dated 20.10.2014 passed in Cr. Misc. No.39541 of 2014 with following observations:- "Since the petitioner is in custody, the learned Chief Judicial Magistrate, Nawadah is directed to hold the trial on day-to-day basis and conclude the same as early as possible preferably within six months from the date of receipt/production of a copy of this order failing which the petitioner would be at liberty to renew his prayer for bail."

It has been contended that the petitioner is in custody

Patna High Court Cr.Misc. No.20454 of 2015 (2) dt.29-04-2015 2/2 since 19th June, 2014. The earlier order passed by this Court was transmitted to the court below on 27th October, 2014 and till date even charges have not been framed.

Regard being had to the observations made in the aforementioned order dated 20.10.2014 passed in Cr. Misc. No.39541 of 2014, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawadah in Trial No.1847 of 2015 arising out of Nawadah Town P.S. Case No.227 of 2014.
