The petitioner seeks bail in Fatehpur P.S. Case No. 326 of 2014, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
The wife of the informant alleged that Kapil Chaudhary took her husband Baljit Manjhi, but her husband did not return. Later on the dead body of her husband was found. She suspected that Kapil Chaudhary had taken Rs. 80,000/- from her husband and for that Kapil Chaudhary, Pappu Chaudhary and Ashish Chaudhary, the petitioner killed her husband and threw his dead body.
Learned counsel for the petitioner submits that there is no eye witness of the occurrence. Kapil Chaudhary has already
Patna High Court Cr.Misc. No.19953 of 2015 (2) dt.17-06-2015 2/2 been enlarged on bail vide Cr. Misc. No. 8515 of 2015 and the case of the petitioner stands on same footing. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gaya in Fatehpur P.S.
