JUSTICE RAKESH KUMAR ORAL ORDER 22-04-2015 This is the second attempt for grant of bail. Earlier, prayer for bail of the petitioner was dismissed on 30.9.2013 vide Cr. Misc. No. 28883 of 2013.

Learned counsel for the petitioner, in presence of learned A.P.P., at the very outset submits that out of ten charge sheet witnesses, seven prosecution witnesses have already been examined.

Keeping in view the fact that trial is already proceeding and out of ten charge sheet witnesses seven have been examined, the court is of the opinion that it would not be appropriate to extend the privilege of bail at the moment.

The petition stands again rejected.

In view of the fact that petitioner is in custody since long and trial is already proceeding, while dismissing the present

Patna High Court Cr.Misc. No.16391 of 2015 (2) dt.22-04-2015 2/2 petition it is desirable to observe that the learned Trial Court may take appropriate steps, so that, trial may come to its logical end without unnecessary delay.
