The petitioner seeks bail in connection with Ramgarhwa P.S. Case No.152 of 2014 registered under Section 395 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that on the basis of the written report of the informant, Manoj Mahto Kharwar, Ramgarhwa P.S. Case No.152 of 2014 was instituted on 28.08.2014 under Section 395 of the Indian Penal Code against unknown. In course of investigation, petitioner was apprehended by the police on suspicion and his confessional statement was
Patna High Court Cr.Misc. No.20300 of 2015 (3) dt.16-09-2015 2/2 recorded as detailed in paragraph-37 of the case diary. Except the confessional statement of the petitioner, there is nothing to show his involvement in the commission of the alleged offence. Moreover, the petitioner is in custody since 08.01.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran, in connection with Ramgarhwa P.S. Case No.152 of 2014.
