The present writ application has been filed for a direction to respondent no.2, the Divisional Commissioner, Koshi Division, Saharsa to dispose of the Arms Appeal No. 84 of 2015 filed against the order dated 26.3.2014 passed by the respondent no.3, District Magistrate, Madhepura, whereby the petitioner's licences for double barrel gun and NP bore pistol were cancelled.

It is submitted by learned counsel for the petitioner that the respondent no.3, District Magistrate, Madhepura vide order dated 25.3.2014, cancelled the petitioner's licences for double barrel gun and NP bore pistol, which gets reflected from the order as contained in Annexure 2. Against the said order, the

Patna High Court CWJC No.4621 of 2017(2) dt.14-11-2017 2/2 petitioner preferred Arms Appeal No. 34 of 2015 on 30.4.2015 but till date the appeal has not been disposed of. Though the counter affidavit has been filed on behalf of respondent nos. 3 and 4 but no reason has been assigned, explaining the circumstances under which the appeal of the petitioner has not been disposed of in two and half years. In the circumstances, respondent no.2, the Divisional Commissioner, Kosi Division, Saharsa is expected to dispose of the Arms Appeal No. 84 of 2015 within a period of two months from the date of receipt/production of a copy of this order in accordance with the provisions of Arms Act.
