JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-399, 402 of the Indian Penal Code and Sections-25(i-b)a, 26 of the Arms Act.
One loaded country-made pistol is said to have been recovered from possession of the petitioner when he alongwith others had assembled to make preparation for committing dacoity, and for the aforesaid offence, he is languishing in jail custody since 22-09-2015. So far as criminal antecedent of the petitioner is concerned; it is informed that prior to institution of the present case, petitioner was made accused in Barauni P.S. Case No. 182 of
Patna High Court Cr.Misc. No.11560 of 2016 (2) dt.15-03-2016 2/2 2012 for the offence punishable under Sections-323, 341 & 379 of the Indian Penal Code but when he was arrested in the present case, he was remanded in Bachhwara P.S. Case No. 164 of 2015 and except the aforesaid cases, petitioner has not been made accused in any other case.
Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bachhwara P.S. Case No. 170 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Begusarai. (Hemant Kumar Srivastava, J) A.K.V./- U T
