JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section and other ancillary sections of the Indian Penal Code.

As per the prosecution case, while the petitioner was trying to steal motorcycle of the informant, he was caught by the informant. In the meantime, he gave knife blow in the stomach of the informant and fled away.

Learned counsel for the petitioner submits that the parties are neighbourer and prior to the filing of this case, mother of the petitioner filed Chapra Town Police Station Case No. 135 of 2022. Though there is allegation of stabbing, but no injury report is on the record. Petitioner has got no criminal antecedent.

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in Chapra town Police Station Case No. 125 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
