Patna High Court Cr.Misc. No.3648 of 2015 (3) dt.22-04-2015 2/2 of the Indian Penal Code and Section 3(2) of SC/ST (Prevention of Atrocities) Act and accordingly, the above-said three petitions are being heard and disposed off by this common order. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
According to prosecution case, the informant is not an eye witness of the alleged occurrence and furthermore, in course of investigation, not a single witness came forward to claim himself to be eye witness of the alleged occurrence. Even if, the prosecution case is accepted in toto, then also, at best, it is a case of last seen.
Accordingly, petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Raja Pakar (Barati O.P.) P.S. Case No. 26 of 2013 to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur. (Hemant Kumar Srivastava, J) A.K.V./- U T
