The petitioner has filed this application for bail in connection with Sessions Trial No. 513 of 2019 arising out of Shahpur P.S. Case No. 389 of 2018 registered for the offence punishable under sections 399, 402 and 414 of the Indian Penal Code and section 25(1-b) a, 26 and 35 of the Arms Act. At the outset it is submitted by learned counsel for the petitioner that the petitioner had moved this Court earlier for bail vide Cr. Misc. No. 43217 of 2019, however the same was rejected by order dated 27.09.2019(Annexure-I) with the observation that the petitioner may renew his prayer for bail after completing one year in custody.

Although charge has been framed, however not a single witness has been examined on behalf of the prosecution. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the observation given in the order dated 27.09.2019 together with the fact that petitioner has remained in custody since 20.12.2018, this court is inclined to enlarge him on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II, Danapur, Patna in connection with Sessions Trial No. 513 of 2019 arising out of Shahpur P.S. Case No. 389 of 2018.
