The petitioners seek regular bail in connection with Paliganj P.S. Case No. 429 of 2019 (Special Case No. 10522 of 2019), registered for the offence punishable under Section 414, 420, 34 of the Indian Penal Code and Section 30(a) of the Bihar Excise Act, 2016.
The allegation is regarding recovery of 396 liters of illicit liquor from the car of the petitioners. The learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in the present case, they are having clean antecedent and they are
Patna High Court CR. MISC. No.4725 of 2020(2) dt.23-01-2020 2/2 languishing in custody since 27.11.2019. It is further submitted that the car does not belong to the petitioners. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioners, coupled with the fact that the petitioners are having a clean antecedent, I deem it fit and proper to direct for release of the petitioners on regular bail. Accordingly, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Patna in connection with Paliganj P.S. Case No. 429 of 2019 (Special Case No. 10522 of 2019).
