JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2020 This is an application for grant of anticipatory bail in connection with Kuchaikote P. S. Case No. 205 of 2016, disclosing offence under Section 393 of IPC. As per F.I.R. there is allegation of snatching the Lap Top, mobile phone from the informant while he was coming on motorcycle, one of the co-accused was arrested, who disclosed the name of the petitioner.

Submission of the learned counsel for the petitioner is that except confessional statement of the co-accused, there is nothing against him. He has falsely been implicated in this case at the instance of police and in earlier case he has been implicated also.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that he is an accused in five

Patna High Court CR. MISC. No.2505 of 2020(2) dt.24-01-2020 2/2 other cases and moreover, in such type of case, unless the accused surrender, the TIP cannot be conducted which is essential in such type of cases.

Having heard both sides, in view of the submissions, made above, I am not inclined to grant privilege of anticipatory bail to the petitioner.
