The petitioner is in custody in connection with Rasulpur P.S. Case No. 266 of 2023 for the offence punishable under Sections 413, 414 and 429/34 of the Indian Penal Code and 11(i) of the Prevention of Animal Cruelty Act, 1960 and 4 of the Bihar Persecution & Improvement of Animal Act, 1955. As per allegation in the FIR, it is a case of recovery of 30 K.G. of raw meat of cattle in a sack from a person riding a M/c.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that nothing has been recovered from the possession of

Patna High Court CR. MISC. No. 5724 of 2024(2) dt.09-02-2024 2/2 the petitioner, petitioner has got clean antecedent as stated in para-3 of the petition and he is in judicial custody since 24.11.2023.

However, learned APP for the State opposes the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail after framing of the charge on furnishing bail bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with connection with Rasulpur P.S. Case No. 266 of 2023. However, the court below is directed to conclude the framing of the charge according to law within a period of one month from the date of receipt of this order.
