The petitioner seeks regular bail in connection with Gopalganj Town P.S. Case No. 708 of 2018, registered for the offence punishable under Sections 420, 406, 409, 423, 424, 182, 187, 467, 468, 471, 477, 120(B) of the Indian Penal Code.
The allegation is regarding the Circle Officer, Gopalganj having filed the F.I.R. stating that one Harendra Ram had filed a petition before the S.D.M, Gopalganj to the effect that the Revenue Karamchari had demanded bribe from the said Harendra Ram for the purposes of effecting mutation
Patna High Court Cr.Misc. No.3374 of 2019(2) dt.24-01-2019 2/3 and releasing receipt thereof. Thereafter, a raiding party was constituted and the house of the said Revenue Karamchari was raided and a bag containing a sum of Rs. 41,500/- and other articles were recovered and the petitioner is said to have been sitting at the house of the co-accused Revenue Karamchari Tarun Kumar.
The learned senior counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and barring the fact that he was found in the house of the said Revenue Karamchari, no other allegation has been levelled so as to connect the petitioner with the alleged crime. It is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 01.12.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No.
