2. Petitioner seeks bail who is in custody since 15.07.2025 in connection with Nawada P.S. Case No. 633 of 2017 for the offences punishable under Sections 396, 397 and 398 of IPC and Section 27 of Arms Act.
3. The prosecution story, in brief, is that on 18-092017 at about 10:00 A.M. three unknown boys came at his jwellery shop situated at Fal Gali, Sonarpatti, Nawada taking out pistols from their waist and pointed at them. Two other boys were watching people outside the shop. After this all three brothers started shouting out of fear, then one of the boys fired which hit his brother, Naresh Kumar in the back due to which he got injured and fell down outside the shop. Thereafter the informant alongwith other brought Naresh Kumar to Sadar Hospital from where he was referred to P.M.C.H. Patna. Then the informant went to Ishwar Dayal Memorial Hospital for better treatment of his brother where in course of his treatment he died.

Learned counsel for the petitioner submits he has been falsely implicated in the present case, it is next submitted that the allegation as alleged in the FIR is forged and fabricated and the petitioner has not committed any offence as alleged in the FIR. It is next submitted that initially the petitioner was not named in the FIR and the name of the petitioner has transpired on the confessional statement of Avinash Srivastav @ Amit @ Abhinash Shreevasta. Learned counsel for the petitioner further submits that the co-accused person has been granted bail by a Coordinate Bench of this Court namely Sahbaz Ansari @ Sonu Ansari vide order dated 02.05.2018 passed in Cr. Misc. No. 19164 of 2018.
5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner and submits that statement of co-accused was recorded in which she has stated that petitioner has fired upon the victim and the same was captured in the CCTV footage.

6. Considering the nature of allegation supported by the witnesses and the CCTV footage, the Court is not inclined to enlarge the petitioner on bail in connection with Nawada P.S. Case No. 633 of 2017, pending in the court of learned Chief Judicial Magistrate, Nawada.
7. Prayer is refused.
